GN 30697: Farm Feeds, Fertilizers, Agricultural Remedies and Stock Remedies Act 36 of 1947 Notice Number 83

The Minister of Agriculture has published a notice under section 1 of the Act to repeal the Notice relating to the extension of the definition Farm Feeds: "to include Farm Feeds prepared for any person in accordance with his discretion for his own use", as published in Government Gazette Notice no: 1013 of 24 August 2007. Thus the extension as written above is no longer applicable.

GN 30824: Tobacco Products Amendment Bill 7 of 2008 Clients are to take note of the contents of the Bill as they will have to bring about the necessary changes to procedures and documentation once the bill becomes an Act in Parliament. We will keep clients informed of any further developments in this regard. Clients must carefully peruse all details of the bill which might be of relevance to their site, some examples have been highlighted below.

The proposed Bill has been published to amend the Tobacco Products Control Act 1993. The following noteworthy changes, inter alia, have been made:

The minimum age for prohibition of sale tobacco products has been raised to 18 years i.e. sale of tobacco products is prohibited to persons under the age of 18 years.
Restrictions on the use of vending machines (previously section 5 of principal Act.)
Information to be displayed at points of sale and on vending machines. (Previously section 6 of principal Act)

GN 30836 Occupational Health and Safety Act 85 of 1993 Draft Diving Regulations, 2007 in terms of the Occupational Health and Safety Act 85 of 1993

The Minister of Labour has published the above DRAFT Regulations for comment by within 90 days from date of publication notice i.e. by 3 June 2008.

All industries that might or will be affected by these regulations are asked to peruse them carefully and give comment within the prescribed period. In comparing the layout of the proposed regulations to the exiting regulation, noteworthy changes have been made to the definitions and content including, inter alia:

1. Diving Contractors (Regulation 3)
Diving contractors are persons who employ person who perform diving operations in a diving project including self employed persons. Diving contractors must ensure that diving projects are planned, managed and conducted in a manner that does not endanger the health and safety of persons involved in the diving project. diving plans must be submitted before commencement of diving projects and a diving project supervisor must be appointed. See Regulation 3 for further details.
 
2.  Diving project plans (Regulation 4)
Diving project plans must be based on a risk assessment conducted prior to the project commences.

GN 30829: Occupational Health and Safety Act 85 of 1993 NN 257: Notice of exemption

The Minister of Labour has published a notice that exemption has been granted in terms of section 40(1) of the Occupational Health and Safety Act 85 of 1993 to applicants who have submitted their application for registration as lifting machine inspectors to the Engineering Council of South Africa before 30 September 2006 (Gazette No. 28755) until 27 June 2008.

NOTE: The above exemption does not apply to persons who examine lifting tackle in terms of regulation 18(10)(e) of the Driven Machinery Regulations.

News: Final Ban on Asbestos The final regulations to enforce the prohibition on the use, processing, or manufacturing of asbestos or asbestos-containing products in South Africa would be gazetted for implementation by the end of Friday the 28th of March 2008.

The use of the material for research purposes would be allowed as long as the research was not undertaken to produce a new asbestos-containing product. Researchers would need to inform Deat of the amount of asbestos used, and the research outcomes on a yearly basis.

Any individuals or merchants which were still dealing in asbestos or asbestos-containing materials would be given a 120-day grace period, until July 27, 2008, to clear their stocks.
